Elizabeth Holmes, the disgraced founder and former CEO of the now-defunct medical technology company Theranos, will not have to report to prison on Thursday, according to Wall Street Journal.
Holmes, who is set to appeal her guilty verdict in the Ninth US Circuit Court of Appeals, filed a request on Wednesday asking if she can stay out of prison, which temporarily puts Holmes's reporting date on hold while the court looks over the request, the outlet reports.
In November, Holmes had filed a request to stay out of prison pending appeal but US District Judge Edward Davila denied the request arguing that the arguments in the court filing weren't strong enough to have a different outcome, and ordered her to appear in court on April 27, 2023, according to WSJ.
The disgraced former biotechnology mogul was sentenced to serve more than 11 years in prison for fraud due to false claims she made about the efficacy of her firm's blood testing technology.
Holmes, 38, who is portrayed by Amanda Seyfried in the Hulu series The Dropout, fell from being crowned as the youngest and wealthiest self-made female billionaire in America at 31 years old by Forbes to losing it all after deceiving investors.
Holmes was convicted in the US District Court for the Northern District of California back in January 2022.
