Non-binary former Biden official and alleged luggage thief Sam Brinton to serve time in men's jail pending trial

Sam Brinton, the former Biden Energy Department official who identifies as “non-binary,” will be incarcerated in a men’s jail in Maryland before he is transported to Virginia to face charges over suitcase thefts.

According to the New York Post, the Montgomery County Sheriff’s Department on Tuesday said that law enforcement would hold the 35-year-old biological male at the county men’s jail with the general population next week.



The Montgomery County Department of Correction and Rehabilitation policy states that inmates are processed and housed according to their biological sex.

The policy reads, “Although MCDOCR does not consider anatomical changes brought about by hormonal therapy to be changes that constitute a change of anatomical sex, the classification of an arrestee/inmate will depend on whether the arrestee/inmate has male or female genitalia, whether they present a management or security problem, and whether their health and safety can be ensured. Once an inmate is classified, they will be given a housing assignment based on that classification.”

Brinton was fired from the Biden administration after being charged in two other unrelated baggage theft cases and was recently arrested and charged with grand larceny by Montgomery County Police Department and Metropolitan Washington Airports Authority (MWAA) Police.

In October 2022, Brinton was charged for allegedly stealing a Vera Bradley bag in September at the Minneapolis-St. Paul Airport. He was later captured on video taking luggage at Harry Reid International Airport in Las Vegas. Brinton was charged, and pleaded "no contest."

Brinton, Biden’s former deputy assistant secretary for spent fuel and waste disposal in the Office of Nuclear Energy, was arrested again last week at a house in Rockville, Maryland, as a “fugitive from justice” for a baggage theft dating back to 2018, when Brinton allegedly took a Tanzanian fashion designer's luggage. 



Brinton was later seen in pictures wearing her one-of-a-kind designs that had been in the suitcase, according to the designer.

The spokesman for the MWAA James Johnson said airport police “executed a search warrant May 17 in Montgomery County, Maryland, in connection with allegations of stolen property in luggage from Reagan National Airport that was brought to the department’s attention in February 2023.”

Johnson added, “With the assistance of Montgomery County Police, Samuel Otis Brinton, age 35, of Rockville, Maryland, was taken into custody Wednesday pending charges of Grand Larceny.”

On May 18, Brinton appeared before Judge Victor Del Pino via closed-circuit television from the Montgomery County Central Processing Unit, where the former Biden official was denied release and ordered to be extradited to Virginia.
