On Saturday, the GiveSendGo fundraising website set up to support former Marine Daniel Penny's legal defense briefly crashed as it was swamped by visitors eager to give money, which has now surpassed $1 million,  following Penny being charged with second degree manslaughter by Manhattan DA Alvin Bragg over the death of 30-year-old Jordan Neely

"UPDATE: We have had a big surge in our traffic and our servers were temporarily overwhelmed. We are aware and are a few minutes from resolving the issue. The campaign for Daniel Penny is over 1 million dollars and the money is secure," GiveSendGo tweeted.

Jack Posobiec noted on Twitter that the link seemed to be down and asked if it was working for other users.  Ian Miles Cheong posted "nope" with a screenshot of the error code.

According to the New York Post, on Saturday people donated at a peak rate of $1100 per minute and the site has over 23,000 donors so far.

Penny's GiveSendGo noted that he was a "college student and decorated Marine veteran" who was "facing a criminal investigation stemming from him protecting individuals on a NYC subway train from an assailant who later died."

According to the website, "Any proceeds collected which exceed those necessary to cover Mr. Penny’s legal defense will be donated to a mental health advocacy program in New York City."

Video footage emerged of the May 1 incident that showed Neely, who later died, being held in a submission hold by 24-year-old Penny. Neely had reportedly been behaving in a hostile and erratic manner on the subway and acting aggressively towards other passengers before being subdued. Video from the incident showed Penny placing Neely in the recovery position after Neely stopped struggling.

Neely, who had been arrested more than 44 times including on charges of public lewdness and assaulting a senior citizen, had a warrant out for his arrest at the time of the fatal incident.
