NY Dem lawmaker facing sexual misconduct allegation claims Adult Survivors Act is 'unconstitutional'—he backed it for use against Trump

A state senator in New York who voted to support an act that is now being used against him amidst rape allegations is now saying it is unconstitutional. The same act was used against former President Donald Trump.  

NY State Senator Kevin Parker previously voted for the Adult Survivors Act, the same act that was used to go after Trump in the E. Jean Carroll lawsuit against him, where he was accused of rape. The act was brought into question by Trump's legal team previously, according to Politico.  

As the New York Post reports, Parker has asserted in a court filing that the law is unconstitutional. The now-expired law gave victims of sexual assault a temporary window to file lawsuits against their accused attackers even if the state's statute of limitations had run out.  

Parker has been accused of raping a woman in 2004 in a lawsuit filed November 2023, a claim that made it just under the wire before the law expired. He has denied the allegations. He, along with every other member of the state senate, voted to approve the law in 2021. When the allegations first came up, he still voiced support for the bill. 

“I voted in favor of the [Adult Survivors Act] to ensure all New Yorkers can seek justice and be heard,” Parker wrote about the law that expired in November 2023. 

“These allegations are absolutely untrue. My work and advocacy will continue,” Parker added.  

Olga Jean-Baptiste claimed that she was working with Parker in Haiti on relief efforts when he then forcibly raped her in her home. New York Governor Kathy Hochul has called the allegations "deeply disturbing."
