BREAKING: Steve Bannon's emergency request to avoid prison rejected by Appeals Court—Bannon to appeal directly to SCOTUS

His lawyers have argued that he should be not be placed behind bars until all appeal options have been exhausted.

On Thursday, a federal appeals court in Washington, DC rejected Steve Bannon's emergency request to avoid prison. The Republican strategist and political commentator is set to report to prison by July 1 to serve his four-month sentence after being found guilty of refusing to comply with a subpoena issued by the January 6 Committee. 

Bannon has vowed to take his case to the Supreme Court if necessary, with his lawyers arguing that he should be not be placed behind bars until all appeal options have been exhausted. 

In their 2-1 ruling, the affirming judges argued that "Bannon's ground for requesting release does not warrant a departure from the general rule that a defendant 'shall ... be detained' following conviction and imposition of sentence of imprisonment." 

The lone dissenting judge cited Licavoli v. United States, a ruling which found that "proof of a deliberate and intentional default establishes the requisite willfulness," arguing that, "because the Supreme Court is not bound by Licavoli, because Licavoli's interpretation of 'willfully' is a close question, and because that question may well be material, Bannon should not go to prison before the Supreme Court considers his forthcoming petition for certiorari."



"I wanna say something specific about the Justice Department, Merrick Garland, Lisa Monaco, the entire Justice Department," Bannon said after learning his fate earlier this month. "They're not gonna shut up Trump, they're not gonna shut up Navarro, they're not gonna shut up Bannon, and they're certainly not gonna shut up MAGA."

"There is nothing that can shut me up and nothing that will shut me up," he added. "There is not a prison built or a jail built that will ever shut me up. All victory to MAGA, we're gonna win this, we're gonna win this at the Supreme Court, and more importantly we're gonna win on November 5 in an amazing landslide with the Senate, the House, and also Donald J. Trump back as President of the United States."
