Fulton County District Attorney Fani Willis is expected to present her case against former President Trump regarding alleged attempts to overturn the 2020 election in the state to a grand jury next week.
Former Democrat state Sen. Jen Jordan and former Lt. Gov. Geoff Duncan (R), who have both been subpoenaed to testify before the grand jury as part of the investigation, told NBC News that they have yet to receive the 48 hours notice cited in the subpoena to appear before the grand jury, indicating that the case will not be presented to jurors this week.
Willis’ investigation into whether there were “coordinated attempts to unlawfully alter the outcome of the 2020 elections” by Trump and his allies in the state has been ongoing since 2021.
Willis has stated that she plans to announce charges by September 1 at the latest.
As the potential fourth indictment against Trump looms, security around the Fulton County courthouse has been heightened.
Sources close to the investigation have said that Willis may charge Trump under the state’s Racketeer Influenced and Corrupt Organizations (RICO) Act.
The list of charges that prosecutors are weighing also includes criminal solicitation to commit election fraud and conspiracy to commit election fraud, as well as solicitation of a public or political officer to fail to perform their duties and solicitation to destroy, deface or remove ballots.
Willis has been investigating alleged efforts by Trump to pressure Governor Brian Kemp and Secretary of State Brad Raffensperger to overturn the election results, as well as a plan to use an alternative slate of electors.
During a speech in New Hampshire on Tuesday, Trump joked, "one more indictment and I think this election is over."
Trump also told the crowd that he expects "by some time next week" to have four indictments against him.
