The Daily Wire has filed challenges against the administration's "tyrannical" vaccine mandate following new requirements set forth on Thursday.
On Thursday, the Biden administration set forth new requirements for workplace vaccine mandates. The changes impact private businesses with more than 100 employees, as well as Medicare and Medicaid workers and facilities.
According to the press briefing, the OSHA issued a rule covering some 84 million employees who are to be required by their employer, per federal rules, to be vaccinated or submit negative COVID tests once per week. Those who do not choose to vaccinate will be required to wear a face mask at work. The deadline to comply is set for January 4, 2022.
Following the announcement from the White House, The Daily Wire issued a press release detailing their filing of a legal challenge with the US Court of Appeals for the 6th Circuit against the vaccine mandate. According to the release, with the help of The Dhillon Law Group, Inc. and Alliance Defending Freedom, they hope to prevent the new requirements from being adopted.
"The Daily Wire will not comply with President Biden’s tyrannical vaccine mandate, and we are suing the Biden Administration to put a stop to their gross overreach," said Daily Wire Co-Founder and Co-CEO Jeremy Boreing, adding that "President Biden, the federal government, social media, and the establishment media have conspired to rob Americans of their freedoms in the name of public health," and "have broken faith with the American people through conflicting messaging, false information, and by suppressing data and perspectives with which they disagree."
Harmeet K. Dhillon of the Dhillon Law Group argues that, "The federal government lacks the legal authority to compel private employers to play the role of vaccine or COVID police, lack the police power to force private employees to undergo medical treatment, and may not ignore constitutional limits on its ability to regulate every aspect of our lives."
The unconstitutional nature of the proposed mandate is central to the challenges made by The Daily Wire and its legal partners.
"Forced to invade employees’ medical choices or histories and their religious beliefs in connection with a condition of employment," the release concludes, "The Daily Wire risks being trapped between its obligations under the mandate and the prohibitions against discrimination under the Americans with Disabilities Act and the Civil Rights Act of 1964, as well as the burdens of laws regulating the possession of private information." They argue that, "The mandate is unconstitutional because the Constitution does not grant Congress—much less OSHA—the general police powers needed to mandate vaccination and virus testing as a condition of private employment, or to deputize employers to enforce that mandate on its behalf."
