On Friday, the 3-judge US Court of Appeals for the District of Columbia granted a temporary stay on a gag order placed on Trump by Judge Tanya Chutkan.

"Upon consideration of the emergency motion for a stay pending appeal, which includes requests for an administrative stay and to expedite the appeal, it is ordered that the district court’s October 17, 2023, order be administratively stayed pending further order of the court."

The case is scheduled for arguments before the appeals court on November 20, 2023 at 9:30 am. 

"No court in American history has imposed a gag order to silence any political candidate—until now. The district court’s unconstitutional Gag Order prevents President Trump—the leading candidate for President of the United States—from engaging in core political speech, which is entitled to the highest level of protection under the First Amendment," the emergency motion, filed by Trump's attorneys on Thursday, began.

"The Biden Administration chose to indict President Trump in the middle of campaign season in a politically motivated attempt to derail his candidacy, and the First Amendment allows President Trump to speak out against this unconstitutional tyranny."
