BREAKING: Michigan Supreme Court REJECTS appeal, Trump to remain on ballot

The court upheld a Michigan Court of Appeals ruling from earlier in the month, which rejected a similar appeal filed by watchdog group Free Speech For People on behalf of Michigan voters seeking to remove Trump from the ballot for the events of January 6, 2021, according to ABC News.

The ruling comes just over a week after Colorado's Supreme Court ruled that Trump is disqualified from being on the state's primary ballot in 2024. That case will likely move to the Supreme Court.

Comparing Michigan to Colorado, Justice Elizabeth Welch wrote that the group bringing forth the appeal "have identified no analogous provision in the Michigan Election Law that requires someone seeking the office of President of the United States to attest to their legal qualification to hold the office," CNN reports.

The appeals court unanimously ruled on December 15 that "Who to place on the primary ballot is determined by the political parties and the individual candidates."

"As the Court of Claims recognized, it would be improper to decide whether to grant a declaration that Trump is disqualified from holding the office of President of the United States at this time."

"At the moment, the only event about to occur is the presidential primary election. But as explained, whether Trump is disqualified is irrelevant to his placement on that particular ballot. Thus, with respect to the presidential primary election, there is no actual controversy, as the only purported basis for removing Trump from the presidential primary ballot would not be a sufficient basis for removal of Trump's name from that ballot," the court said.
