The judge overseeing Manhattan DA Alvin Bragg’s falsified business records trial rejected a mistrial request from Donald Trump’s team on Tuesday after his defense team said porn star Stormy Daniels’ testimony was "extremely prejudicial."

"I don’t believe we’re at the point where a mistrial is warranted," Judge Juan Merchan said, according to the Associated Press.

Defense lawyer Todd Blanche said after the lunch break that Daniels’ testimony regarding the alleged sexual encounter she had with Trump as well as the conversation that came before and other meetings with him had "nothing to do with this case and is extremely prejudicial."

Blanche said that "the court set guardrails for this testimony" but it was "just thrown to the side."

"This is the kind of testimony that makes it impossible to come back from," Blanche said, noting that it is also "unfair" as Trump will be out on the campaign trail later today.

Daniels’ testimony, Blanche said, was meant to embarrass Trump and "inflame the jury." He added that the testimony was "so prejudicial that there’s a risk the jury won’t be able to focus on the evidence" of the case itself.

Merchan agreed that Daniels said more than needed to be said at times, adding "I agree there are some things that would’ve been better left unsaid," and noting that the "witness was a little difficult to control."

In a post to Truth Social, Trump wrote, "THE PROSECUTION, WHICH HAS NO CASE, HAS GONE TOO FAR. MISTRIAL!"

This is a breaking story and will be updated.
