He said it was “frustrating,” and that the holdout juror “explicitly said, you know, I don’t know if the prosecution or the defense proved their case.”
One of the three men who were on the jury for the trial of Lindsay Clancy has spoken out, bringing the total to 5 jurors who have spoken to the media in the wake of the trial ending in a mistrial declaration. Juror number 10, Nick Dargie, told ABC News about the actions of the lone male holdout juror who would not find Clancy not guilty by reason of insanity.
Dargie told ABC News that there had been a few jurors who wanted to find Clancy guilty, but that was whittled down to the holdout. He said it was “frustrating,” and that the holdout juror “explicitly said, you know, I don’t know if the prosecution or the defense proved their case.”
He said, “there was times where, you know, our vote was different than the last day, but I think ultimately, once we laid out all of the evidence and how we saw it, that really brought everyone kind of on the same page, except for this one juror. There was several times that I would ask him to show us evidence or, you know, describe a witness testimony that helped [rove what he was saying, and he couldn’t, which is why we ultimately sent in that note.
“Otherwise, like there's nothing wrong with somebody having a completely opposite opinion. That’s, you know, that would be a hung jury. That is our justice system.”
He claimed the holdout juror at times “wouldn’t engage, like he’d be scrolling on his phone while people are talking to him, things like that.”
He said that at one point during the deliberations, the holdout juror picked up the exercise band used by Clancy to strangle her children, tied it around a water bottle, and pulled it. When asked if the juror explained why he did it, Dargie said, “No. He might have. I’m not entirely — I think I was just so shocked that he did that.”
ABC’s Aaron Katersky asked, “Is that a mimic of how she killed the children?” Dargie replied, Yeah, I assume so.” He continued, “I was shocked. It didn’t make any sense to me. We’re not in here to play detective, or it’s not a game of Clue. Like, this is serious.”
He said that if the case goes to a retrial, if the prosecution “tried the trial again the way they did, I think nine times out of 10, I think a jury would come back with a not guilty by reason of insanity.”
Katersky said Dargie had told him he and the other jurors had been “devastated” that they were deadlocked.
Three female jurors spoke with local news, with one of the jurors saying that the holdout juror was “very arrogant,” and that he “completely disregarded the information” that nurses on the jury spoke about regarding a toxicology report.
