Daily Wire CEO: Supreme Court ruling is humiliating defeat for Biden

Jeremy Boreing, the co-founder and CEO of The Daily Wire, says that the Supreme Court ruling against President Joe Biden’s employer vaccine mandate is a "...victory for The Daily Wire, American liberty, and a humiliating defeat for Biden’s impotent administration."

The Daily Wire, which was one of several independent employers who led the fight against Biden’s unconstitutional mandate, scored a major win in court today after the Supreme Court ruled 6 to 3 in opposition to the Biden administration’s vaccine mandate, which was pushed through the Occupation Safety and Health Administration (OSHA).

"Today’s decision by the Supreme Court is a resounding victory for the American people and our founding idea that this is a limited government of enumerated powers which exists to protect, not erode, our God-given freedoms. It is also an utter and humiliating defeat for Joe Biden’s impotent administration," said Boreing in a statement.

"The Court’s 6-3 ruling renders Biden’s grotesque overreach into the private health decisions of 85 million Americans as good as dead. We thank our members, fellow complainants, and the over 1 million Americans who signed our 'Do Not Comply' petition and helped The Daily Wire bring the first lawsuit in the nation against the mandate — we celebrate with you today. By the grace of God, we still have our freedom," he added.

In September 2021, Biden announced through OSHA the plan to require all private companies with 100 or more employees to force unvaccinated employees to get the jab or be subject to weekly testing and masking requirements or face penalties such as fines or losing their job. Companies that failed to adhere to the requirement would, in turn, also face fines.

Within days of the announcement, The Daily Wire, which is represented by the Alliance Defending Freedom and the Dhillon Law Group filed an emergency motion to halt enforcement of the mandate.

On November 16, a random lottery was held by the US Judicial Panel on Multidistrict Litigation, and the US Court of Appeals for the 6th Circuit was chosen to decide all qualified lawsuits challenging the federal government’s private employer vaccine mandate. The Daily Wire v. Occupational Safety and Health Administration was consolidated into a new case along with other clients represented by ADF.

On December 17, the 6th Circuit lifted the stay issued by the 5th Circuit on November 4, which had effectively halted implementation of the Occupational Safety and Health Administration vaccine mandate. The Daily Wire’s legal team filed an emergency application for stay the Supreme Court following a ruling by a three-judge panel of the US Court of Appeals for the 6th Circuit that allowed OSHA to enforce the vaccine mandate.

Over a million people signed The Daily Wire petition urging the Supreme Court to rule against the mandate and declare it unconstitutional.
