McCormick's appeal states, "The Board's decision is legally erroneous because undated or misdated mail ballots are invalid as a matter of law and cannot be counted in the 2024 General Election - as the Pennsylvania Supreme Court has already made clear."
It later adds that the decision from the board "directly contravenes binding Pennsylvania law." An automatic recount in the Pennsylvania US Senate race has been put into motion because McCormick had less than a 0.5 percent lead over Sen. Bob Casey (D-PA), the Democrat incumbent in the race, per WGAL. Earlier this week on Wednesday, the recount was announced, however, the Bucks County Elections Board ruled that in the recount the 405 ballots not dated or dated improperly will be entered into the recount.
According to Fox News, the Pennsylvania Supreme Court ruled prior to the election that ballots mailed into polling locations without dates or formal signatures should not be counted. However, Bucks County and several other Democrat-controlled areas are blatantly ignoring the ruling.
Democratic Bucks County Commissioner Diane Ellis-Marseglia said of the situation, "I think we all know that precedent by a court doesn’t matter anymore in this country." She and other Democrats voted to reject a challenge spearheaded by the GOP to toss out the ballots that were ruled by the court to be illegitimate.
When the board voted to make the decision, the Bucks County GOP posted, "Democrat Commissioners Diane Marseglia and Bob Harvie voted today to count illegal ballots, against PA Supreme Court ruling, in an attempt to aid former Senator Bob Casey."
