"The subpoenas that we issued did ask for communication regarding ad buys because it was relevant to the false statements we were investigating," Smith claimed.
Smith, who was brought in to testify before Congress over his numerous subpoenas against different Republican lawmakers, voters, and organizations, admitted before Congress that he obtained a court order to access the records of ad purchases of Fox News.
The admission came when Cruz was questioning Smith over the subpoenas that were ordered against over 400 Republicans and conservative organizations.
"Did your team subpoena Turning Point USA?" Cruz asked.
Smith said he did not recall, but could explain a number of different subpoenas if he was able to look at the records.
"Do you have any idea who you subpoenaed? Can you name one? All right, let me help you. Did your team subpoena the Conservative Partnership Institute?" Cruz asked.
Smith said that he did remember the subpoenas for CPI and then said that he could "explain" it, but Cruz kept going.
"Did your team's ... subpoenas demand communications with Fox News?" Cruz asked.
"The subpoenas that we issued did ask for communication regarding ad buys because it was relevant to the false statements we were investigating," Smith claimed.
"Purchasing advertising on a news agency, you somehow believe is criminal," Cruz said. He then asked if Smith had subpoenaed donor as well as fundraising data.
Smith said that he did not know. "I do not recall because I've not seen those subpoenas in a very long time," he said.
