JUST IN: Tim Pool announces plan to sue Kamala Harris campaign for defamation

Tim Pool is planning to take legal action against the presidential campaign of Kamala Harris. Her campaign account on X, Kamala HQ, posted an out-of-context clip and then claimed that Pool was calling for the death penalty against Democrats should Trump gain a second term in office.

"Trump operatives say their Project 2025 plan is to give Trump total, unchecked legal power so they can jail and execute those who don’t support Trump if he wins," Kamala Harris' campaign posted on X, noting by way of accusation that "They have since scrubbed this video from YouTube."

In response to the post, Pool said "I have engaged legal counsel. We are preparing to take action. More to come."

That "more" came on Tuesday when Pool addressed the post and the allegations on his morning broadcast. Not only is Pool not at all affiliated with the Heritage Foundation's Project 2025 nor with the Trump campaign, he staunchly opposes the death penalty and has for the entirety of his career. He walked through the defamatory comments from Harris' post and debunked each one, including the inferred allegation that the video was "scrubbed" to hide the commentary. It was in fact removed by Pool precisely because he does not advocate for or condone advocacy for a death penalty.

"I feel that the lies from the Kamala campaign have become so shockingly, shockingly egregious, they strike at the conscience of any good, rational American," Pool said as he detailed the reasons behind the forthcoming suit.

"We are preparing a lawsuit against the Kamala Harris campaign due to a defamatory statement posted on X which is extreme, egregious," Pool said, "and I just got to say, outright psychotic in accusing me, me personally, as well as Laura Loomer, but we are two separate individuals, of calling for unchecked legal power so that they, meaning Trump and his allies, can jail and execute anyone who doesn't support Trump if he wins, which is a shocking and egregious lie that goes so far beyond the pale. I, well, I just can't even. It's shocking and downright insane."

Pool set the record straight, saying he is not "a Trump operative" and that he does "not work for the Trump campaign." He's received no money from the campaign and has not received any outside investment for the show. "It's all been funded from the ground up."

"I am in no way associated with Project 2025," he continued, "though I've interviewed some of the people who are associated with Project 2025 and have been involved, Timcast is not, has not, and will not be a part of or in any way related to Project 2025, nor have I ever called for anyone to have unchecked legal authority. And I will stress this, because this is the most shockingly offensive part of what they said, and I'm jumping right to the beat, right away, so I don't waste your time, because I have a lot to talk about.

"I am opposed to the death penalty in all circumstances," Pool said unequivocally. "I have argued against the death penalty in every circumstance. I do not trust the government to decide who gets to live and die, and I will never support the death penalty or any type of executions. For that matter, the clip in question posted by the Kamala campaign was literally me arguing against the idea of the death penalty, telling Laura Loomer that she was wrong. Individuals did not commit treason, more likely sedition."

After stating that he has "engaged legal counsel," Pool said "My intention is to immediately file a lawsuit and approach every legally correct avenue to do that, and so I will stress one more time. So far, I've contacted my legal counsel. We have discussed the issue at length. We intend to file a lawsuit. The reason why I say intend is I'm not, I'm not exactly sure I'm not a lawyer myself. All I can do is inform you that I have, we have begun this process, and I fully intend to see it taken to this degree."

While he in no way supports capital punishment, Pool does believe that criminals should be prosecuted and punished for their crimes, and that many high-ranking Democrats have committed crimes in office for which they should be prosecuted under the law. Among these are President Joe Biden, who was found to have unlawfully absconded with classified documents at the end of his vice presidential term under Barack Obama. An investigation by the Department of Justice revealed this, yet Biden was not prosecuted because appointed special counsel Robert Hur determined that the president is too kindly and old to face that kind of ordeal. Donald Trump is being prosecuted for taking classified documents after his term in office, though in his case he, as president, had the ability under the Presidential Records Act to determine which documents were for his personal record and which were not.

Head of the DOJ, Attorney General Merrick Garland, could also be one who would face prosecution for his refusal to apply the law equally in the case of the classified documents held by both men, or for his partisan prosecution of J6ers, or for instructing the FBI to investigate parents who complained at school board meetings with the same tools used to prosecute domestic terrorism. One of those parents was a father demanding answers as to why the rape of his daughter in a gender-neutral bathroom by a skirt-wearing male student had been covered up. Garland has also flouted a congressional subpoena and refused congressional orders to turn over documents in special investigations.

Charlie Kirk, who has also been lied about by Harris and her campaign, applauded the move, saying "Good. This account is getting out of control. So much is verifiably inaccurate, there must be accountability."

Kamala HQ "is the official rapid response page of Vice President Harris’ presidential campaign," meaning that anything and everything the account posts is sanctioned by Harris.

Harris has lied about Trump's position on abortion, IVF, his recent attendance at a memorial service for soldiers who died under her watch, his position on the military itself, his relationship to the policy detailed in Project 2025, and repeated debunked lies about her opposition. She has also lied about conservatives and Republicans who support Trump, such as Kirk, whom she called a "MAGA operative."

Here's hoping Tim gets his oft-repeated wish to sue his detractors in West Virginia, his home state and corporate headquarters. Since he's not suing X, the suit doesn't have to be filed in CA in accordance to X's TOS, as I see it. IANAL, though, so...
