Democrat Nevada AG Aaron Ford plans to appeal the ruling.
The dismissal of the case is the latest legal setback for the state, which has relentlessly gone after the slate of alternate electors who wanted to challenge the results of the 2020 election. The defendants in the case included Chairman of the Nevada Republican Party Michael McDonald, former vice chair Jesse Law, Nevada vice chair Jim Hindle III, Nevada GOP National Committeeman Jim DeGraffenreid, Shawn Meehan, and Eileen Rice.
In the wake of the 2020 election, the group gathered and signed a statement claiming that Trump had won the state's electoral votes. The defendants said that signing the certificate was an act of "political theater" that was publicizing their concerns about the election and were only preserving their right to challenge the results, but did not intend to use the certificate to deceive a government agency."The fact that Defendants openly announced both their actions and their asserted purpose, rather than concealing their conduct or attempting to secretly induce governmental reliance, weighs against a reasonable inference that they acted with fraudulent intent," Nevada Judge Mary Kay Holthus said in the ruling, per The Hill.
Democrat Nevada Attorney General Aaron Ford plans to appeal the ruling.
"The District Court’s decision is, once again, wrong, and we will appeal to the Nevada Supreme Court, just as we did when the court first dismissed our case against these defendants,” Ford said in a statement. “My office will continue to work to hold these fake electors accountable for their actions which attempted to undermine our democracy and erode trust in our elections.”
Three other alternate electors cases have also been dismissed in Arizona, Michigan and Georgia. Nevada Attorney General Aaron Ford, who is running for Nevada governor as a Democrat, brought the forgery charges against the six alternate electors for "offering a false instrument for filing or record."
