New Jersey Democrats have advanced a measure that would criminalize those who interfere with access to transgender and reproductive health care. The measure was approved in the Assembly Appropriations Committee along party lines and cleared the way for a potential vote in the full chamber before it reaches Democratic Gov. Mikie Sherrill for her signature.
If passed, the measure would make New Jersey the first state to explicitly criminalize interference with abortion or sex changes. These protections would extend to those in New Jersey who travel from states where such activities are prohibited. The Senate previously voted 23-12 along party lines to pass the measure in May.
"This bill is to protect health care. Not a political debate. Not a culture war talking point. Health care," bill sponsor Sen. Teresa Ruiz, D-Essex, previously said, per the New Jersey Monitor. "Our law enforcement will not carry out another state's agenda."
The measure has drawn criticism, with some Republicans arguing that the bill could infringe on free speech and parental rights and transform New Jersey into a sanctuary state for such procedures.
The measure would make it a fourth-degree crime to harass, harm, or block individuals from accessing or providing abortion and transgender services. The bill also provides protection against states that have criminalized these treatments. Violators who inflict bodily injury on these individuals could face up to 10 years in prison and a fine of up to $150,000 per Fox News.
Supporters of the legislation argue that it is necessary to ensure patients and medical providers can access and deliver health care services without fear of intimidation. They contend that increasing legal protections is especially important as several states have enacted restrictions on abortion and transgender treatments. Opponents of the bill, however, maintain that the bill raises concerns about government overreach and could create conflicts involving free speech and parental authority.
