Manhattan DA Alvin Bragg's office said it won't oppose delaying the sentencing hearing against President Donald Trump, originally set for July 11. This comes after Trump's legal team filed motion to overturn the conviction against him due to the Supreme Court's ruling in favor of his immunity motion in the federal J6 case against him in Washington, DC. Bragg requested that his office be given until July 24 to respond.
Trump was found guilty of 34 counts of falsifying business records after Bragg alleged that Trump had classified payments to his then-attorney Michael Cohen as legal fees, when in fact, per Bragg, the monies were a reimbursement for Cohen's payments to a woman with whom Trump is alleged to have had an affair. For Bragg, this constituted election interference and was therefore a felony. Given that the Court stated that former presidents have immunity for official acts, and Bragg claimed Trump committed the crimes in service to his role as president, the immunity ruling could apply.

View on RumbleAssistant District Attorney Joshua Steinglass responded to the Trump team in a letter from the DA's office, saying "We are in receipt of defendant's pre-motion letter dated July 1, 2024 seeking leave to file a motion to set aside the verdict pursuant to CPL § 330.30(1) based upon the Supreme Court's July 1, 2024 decision in Trump v. United States, 2024."
"In that letter, defendant requested until July 10, 2024 to submit a memorandum of law in support of such motion. While defendant's letter states that he does 'not object to an adjournment of the July 11, 2024 sentencing date,' his request to file moving papers on July 10 is necessarily a request to adjourn the sentencing hearing currently scheduled for July 11, 2024 pending resolution of the motion," the letter from Steinglass added.
“Although we believe defendant’s arguments to be without merit, we do not oppose his request for leave to file and his putative request to adjourn sentencing pending determination of his motion. We respectfully request a deadline of July 24, 2024—two weeks after defendant's requested deadline—to file and serve a response," it concluded.
Per Judge Juan Merchan, who oversaw the case, sentencing has been moved to September 18 in New York. The presidential election is on November 5.
