BREAKING: Fani Willis may be disqualified from Trump RICO case over affair with prosecutor, ‘evidentiary hearing must occur’: judge

Fulton County Judge Scott McAfee, who is presiding over the RICO case, made the comments at the beginning of a hearing on Monday, according to ABC News.

"I think it's possible that the facts alleged by the defendant could result in disqualification, I think an evidentiary hearing must occur to establish the record on those core allegations." Willis sought to have an evidentiary hearing coming up on Thursday dismissed, however, McAfee said it will proceed as planned.

Codefendant in the case with Trump, Michael Roman, filed a motion last month seeking to dismiss the charges against him and the former president on grounds that Willis and her lover, Wade, financially benefitted from prosecuting the case. Later in January, Trump and Roman's lawyer Ashleigh Merchant filed a lawsuit in order to access financial records of the Fulton County DA's office.

It was revealed earlier in the month that prosecutor Wade had bought plane tickets in Willis' name to destinations such as Miami and San Francisco.

A subsequent filing by Willis admitted to a "personal relationship" to the Georgia prosecutor but argued that there was no financial interest for herself or Wade. This was despite Wade getting paid much more than other state prosecutors.

In the filing, Willis argued, "Special Prosecutor Wade made much more money than the other special prosecutors only because Wade did much more work" on the Trump case.
