A Nevada judge has dismissed the alternate electors' case against allies of Donald Trump in Nevada over concerns with jurisdiction. Judge Mary Kay Holthus dismissed the charges against the six Nevada Republicans in the decision.
On Friday morning, Judge Mary Kay Holthus told prosecutors that she remained unconvinced that Clark County was the appropriate jurisdiction to hear the case. “You have literally, in my opinion, a crime that has occurred in another jurisdiction,” Holthus stated. “It’s so appropriately up north and so appropriately not here," according to The Daily Indy.
Clark County tends to be more Democrat, meaning that the jury may have been less favorable to the Republican defendants than if the case were tried in a different jurisdiction.
Nevada Attorney General Aaron Ford made a statement immediately after, saying that the "state got it wrong" and that he would appeal to the Nevada Supreme Court.
The defendants in the case were Nevada GOP Chairman Michael McDonald, Republican National Committeeman Jim DeGraffenreid, Clark County GOP Chairman Jesse Law, state party Vice Chair Jim Hindle, Shawn Meehan and Eileen Rice. Each had been indicted on two counts by a grand jury for their role in crafting the slate of alternate electors in the 2020 election to support Trump.
The state will be unable to re-file the case again up north as the three-year statute of limitations on the case expired in December. The Nevada Attorney General’s Office filed the charges in Clark County and previously argued that the jurisdiction was good for the case. The state AG had alleged that two of the defendants conspired to make key documents to the case while they were in Clark County.
