An armed home invader was left in critical condition after allegedly breaking into the wrong person's home in North Carolina on Tuesday.
According to the Mount Airy Police Department, they responded to a residence after receiving a call about a shooting around 4:19 pm, WFMY reported.
When first responders arrived on the scene in the 300 block of Andrews Street, suspected burglar Daniel Scott Laskey Brown, 26, was found with a gunshot wound to his neck in the front yard of homeowner Joshua Wade Murphy, 41.
Police said that Brown allegedly broke into Murphy's home via the front door armed with a gun. According to the Daily Mail, the firearm was a pistol.
Once inside the home, Brown was shot in the neck by Murphy.
Brown was taken to Atrium Health Wake Forest Baptist Medical Centre in critical condition, where he remained at least until Wednesday, according to police.
Under North Carolina's "Castle Doctrine," property owners can legally use deadly force against an intruder with no legal obligation to back down. This right extends not only to a person's home, but also to their vehicle and workplace, according to Raleigh's Scharff Law Firm.
While no charges were filed against Murphy, police said that the Surry County District Attorney's Office decided that there would be no criminal charges issued against the alleged burglar as well.
