In the wake of US District Judge Paul A. Engelmayer issuing an emergency order to pause access to the federal Treasury payment system for DOGE, Rep. Eli Crane announced that he is drafting articles of impeachment for the judge.

"I’m drafting articles of impeachment for US District Judge Paul Engelmayer. Partisan judges abusing their positions is a threat to democracy," Crane wrote. "The left has done 'irreparable harm' to this country. President Trump and his team at DOGE are trying to fix it."

Crane added, "This is obviously judicial overreach. Judge Engelmayer is attempting to stop White House employees from accessing the very systems they oversee. Where in the constitution does it say a President and his team cannot root out obvious waste, fraud and abuse?"

On Saturday, Engelmayer issued the emergency order in response to a lawsuit brought forth by New York Attorney General Letitia James and 18 other Democrat attorneys general after funds going to climate change programs got paused. The suit accuses DOGE of "attempting to access government data to support initiatives to block federal funds from reaching certain disfavored beneficiaries," and that President Trump and Treasury Secretary Scott Bessent failed to "faithfully execute the laws enacted by Congress."

Engelmayer said in his order that Musk’s team and other employees granted access need to "destroy any and all copies of material downloaded from the Treasury Department’s records and systems" since January 20. Engelmayer also restricted the Trump administration from giving system access to those who have been designated as "special government employees."
