Middle Tennessee State University student is suing her school and the director of her faculty after the nursing program mandated all students receive a vaccine. According to News Channel 5, Avery Garfield filed her lawsuit in the Rutherford County Chancery Court in early August.
In an email to students, Dr. Jenny Sauls noted there would be no exceptions for the mandate and those who do not comply will be suspended from the program. The department argues it received a notice from its clinical facilities that would require vaccinated students to fulfill their rotations.
Nonetheless, the suit states Garfield did not "consent to being a human subject in experimental medicine."
"In violation of state law, which forbade MTSU from requiring a COVID-19 vaccine, the MTSU Nursing students were thanked for their 'compliance' while MTSU flagrantly violated state law," plaintiff attorney Russell Newman wrote in the suit.
"Apparently, students reacted negatively to MTSU's COVID-19 vaccine mandate as another email was sent out to all MTSU Nursing Students and Dr. Sauls doubled down on MTSU's illegal COVID-19 vaccine mandate," Newman continued.
While the school has yet to comment, Newman notes that he and his client request a permanent injunction because of the mandate.
A hearing for the case has yet to be scheduled.
