Biden demands SCOTUS term limits, amendment limiting presidential immunity in retaliation for Dobbs, Trump decisions

President Joe Biden is demanding the country adopt new amendments to the Constitution in response to the Donald Trump immunity and Dobbs decisions. The measures would overhaul decades of precedent. Biden is demanding term limits on the court as well as an amendment to reverse the Trump decision on presidential immunity.

In an opinion piece for the Washington Post, Biden voiced his demand to introduce term limits for the Supreme Court, as well as introducing a "No One is Above the Law Amendment," that would say there is "no immunity for crimes a former president committed while in office." He claimed that the Dobbs decision overturning Roe v Wade was "dangerous and extreme" and that the court is mired in scandals.



The President wrote, "The Supreme Court’s 6-3 decision on July 1 to grant presidents broad immunity from prosecution for crimes they commit in office means there are virtually no limits on what a president can do."

This portion of Biden's opinion piece is not in line with the immunity decision, which reads, "The nature of that power requires that a former President have some immunity from criminal prosecution for official acts during his tenure in office. At least with respect to the President’s exercise of his core constitutional powers, this immunity must be absolute."

"As for his remaining official actions, he is entitled to at least presumptive immunity," meaning that the immunity for actions outside "core constitutional powers" is not absolute, according to the decision. In addition, the decision says, "As for a President’s unofficial acts, there is no immunity."

Biden went on to demand that there be term limits on the court, with an amendment that would have a president "appoint a justice every two years to spend 18 years in active service on the Supreme Court." If the Amendment passes immediately, the three justices on the court that could soon be removed from the court would include Justices Clarance Thomas and Samuel Alito as well as Chief Justice John Roberts, some of the more conservative justices on the court in 2024.

The president claimed, "I have great respect for our institutions and the separation of powers" and added that "what is happening now is not normal, and it undermines the public’s confidence in the court’s decisions."

In addition to calling for a "binding code of ethics," Biden said that he wanted to introduce these reforms in the face of "increasing threats to America’s democratic institutions." He claimed these changes would "restore trust and accountability to the court and our democracy."
