The two Border Patrol agents who reportedly fired their weapons during the fatal shooting of Alex Pretti in Minneapolis have been placed on administrative leave.

It remains unclear exactly when the two agents were placed on leave. Federal agents who are involved in a shooting are typically put on leave as part of standard protocol while an investigation is conducted. However, Border Patrol official Gregory Bovino had previously told reporters on Saturday that the officers were still working, but had been reassigned to a different city.

A preliminary report from a U.S. Customs and Border Protection internal investigation led by the Office of Professional Responsibility was sent to Congress on Tuesday. According to the report, during the January 24 shooting, an officer yelled, “He’s got a gun!” multiple times, and “approximately five seconds later a BPA [Border Patrol agent] discharged his CBP-issued Glock 19 and a CBPO [Customs and Border Protection officer] also discharged his CBP-issued Glock 47 at Pretti.”

The report did not clarify whether bullets from both firearms struck Pretti.

Senator Rand Paul has called for an independent investigation into Pretti's death, urging DHS to appoint a commission.

"I don’t think it’s honest to say [Pretti] brandished a weapon. I don’t think it’s honest to say he assaulted officers," Paul told reporters. "I’m not saying he might not have been obnoxious. I’m not saying he might have said obnoxious things, but he films; he doesn’t even obstruct the traffic. He waves a car through in the middle of this as they approach him. He retreats as they approach him again, he retreats when a woman is shoved to the ground, he goes to help her up, and that’s when he is grabbed from behind."
