BREAKING: DC appeals court rules Trump does not have presidential immunity in J6 case, Supreme Court appeal expected

On Tuesday morning, a federal appeals court ruled that 2024 GOP frontrunner Donald Trump does not have presidential immunity in the January 6 and 2020 election case brought forth against him.

According to NBC News, the three-judge panel of the US Circuit Court of Appeals for the District of Columbia ruled that there was no basis for Trump’s claim of presidential immunity. Trump is expected to appeal the case to the Supreme Court.
 

The appeals court judges wrote in the ruling that three separate immunity arguments made by Trump’s team were rejected "both as a categorical defense to federal criminal prosecutions of former Presidents and as applied to this case in particular," according to CNBC.

"For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant," the panel wrote.

"But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution."

This comes as Judge Tanya Chutkan, who is overseeing the case brought forth by Biden special counsel Jack Smith, officially suspended the trial’s start date of March 4. The case was paused in December pending an appeal of Chutkan’s ruling against Trump’s motion to dismiss the case over presidential immunity claims.

The Supreme Court in December said that it would not take up Smith’s request to fast-track the immunity claim case while the appeals court heard the case.

Leading up to the decision, Trump posted to Truth Social on Monday night, "If immunity is not granted to a president, every president that leaves office will be immediately indicted by the opposing party."
