The order from Chief Justice John Roberts placed on hold a lower court’s ruling that had reinstated Slaughter while the case continues.

In an order issued Monday morning, the Supreme Court allowed President Donald Trump to fire Rebecca Kelly Slaughter from the Federal Trade Commission. The order from Chief Justice John Roberts placed on hold a lower court’s ruling that had reinstated Slaughter while the case continues.

The order stated, "Upon consideration of the application of counsel for the applicants, it is ordered that the July 17, 2025 order of the United States District Court for the District of Columbia, case No. 1:25-cv-909, is hereby stayed pending further order of the undersigned or of the Court. It is further ordered that a response to the application be filed on or before Monday, September 15, 2025, by 4 pm (EDT)."

Slaughter was fellow Democrat FTC commissioner Alvaro Bedoya were fired by Trump in March. Both commissioners challenged the firings, but Bedoya later dropped out of the case, per NBC News. While the case is making its way through the courts, Slaughter had been listed as a serving commissioner. Following the order, however, Slaughter's name was moved to the former commissioners list.
 

In July, a federal judge ruled in favor of Slaughter, citing a 1935 ruling that upheld limits on the president’s ability to fire FTC commissioners without cause. Lawyers for the Trump administration argued that the removal restrictions unlawfully impose limits on the president’s power under Article 2 of the Constitution to control the executive branch.
