A New York judge is also set to issue a temporary restraining order on Wednesday.
A federal judge in Texas has signed a restraining order blocking the Trump administration from deporting three Venezuelan men under the Alien Enemies Act until they can make their case in court to fight their deportation.
Judge Fernando Rodriguez Jr. signed the temporary restraining order on Wednesday, blocking three men who are being detained at a Texas facility from being deported. One of those three men has HIV and fears losing his medical care if deported, the Associated Press reported.
A New York judge is also set to issue a temporary restraining order on Wednesday, with Judge Alvin K. Hellerstein saying during a New York hearing that he planned to do so. In the New York case, two Venezuelan men being held in Orange County are fighting deportation.
The Trump administration has said that the men belong to the violent Tren de Aragua gang, which the men’s attorneys have disputed.
This comes after the Supreme Court ruled that the Trump administration could continue using the Alien Enemies Act to deport illegal immigrants as litigation plays out in courts. In March, Trump invoked the act to swiftly deport members of the violent Tren de Aragua gang. Trump said in response to the ruling, "The Supreme Court has upheld the Rule of Law in our Nation by allowing a President, whoever that may be, to be able to secure our Borders, and protect our families and our Country, itself. A GREAT DAY FOR JUSTICE IN AMERICA!"
