In an interview that aired on Monday morning, the attorney representing the lone holdout juror in the Lindsay Clancy trial spoke out about his client, Michael Desronvil, and the pushback he has faced in the wake of the mistrial. The Clancy trial ended with a hung jury in early September, with Desronvil being the only juror who wanted to find her guilty of killing her three children.
Attorney Edward Paltzik told Fox News’ Kayleigh McEnany regarding claims that his client had not followed reasonable doubt law during deliberations that Desronvil had “zero doubt,” and that the juror had “a mountain of evidence” to support his position. The remaining 11 jurors wanted to find Clancy not guilty by reason of insanity.
Paltzik said that Clancy attorney Kevin Reddington was “off the rails” for accusing Desronvil of breaking the law during deliberations by making a false statement under oath, adding that Reddington “is clearly attacking the Sixth Amendment. He’s clearly attacking the right to trial by jury.”
Paltzik said “it was horrifying” when Reddington had referred to the holdout juror as a man during the trial, which shrunk the number of possible identities from 12 people down to three. The jury makeup was nine women and three men. “It was beyond the pale. And Kevin Reddington did not do that for any legitimate purpose … the purpose all along was to out Michael.”
He said that Reddington’s emergency motion filed just as a mistrial was about to be declared, suggesting that the holdout juror was biased against those suffering from mental illness, was “frivolous,” and that the motion “is a direct attack on the United States Constitution.”
“Everything that Kevin Reddington is saying is false. It’s completely false. It’s completely outrageous, and Kevin Reddington is just upset that he lost out on his legacy moment. He was one vote away from winning a trial that would have been the capstone of his career, and he didn’t get it, and he lost his mind because of it.”
He said he “100%” intends to file a bar complaint against Reddington, and that while it's early to talk about defamation lawsuits, “I can say this: Kevin Reddington’s conduct is not consistent with the standards of professionalism that we expect from members of the bar.” He added, “If you’re an officer of the court and you have taken an oath to uphold the United States Constitution, you’ve sworn to defend the Constitution, and then you get out there right after the trial and you attack a juror, but then you don’t stop.” He said that Reddington “is not behaving rationally anymore. This is nuts.”
Speaking about Desronvil being called an “obstructionist juror” by Reddington, Paltzik said, “that is one of the most shocking things I’ve ever heard. But I appreciate the fact that Kevin Reddington says the quiet part out loud. That’s the one thing that I’m going to thank him for. He tells you exactly what he’s thinking, and what he’s thinking is unacceptable. It has no place in the law, and it’s the exact reason why he needs to be disciplined.”
Speaking on the over 30 hours that Desronvil held out for, Paltzik said, “It was an intense experience, and the pressure was unimaginable.” He said that most other people would have folded, but “Michael did not because he is an uncommon man. He’s an extraordinary man, and what he did was extraordinary. He is a brave man, he’s a courageous man, he’s a kind man, a decent man, but he’s also a man who cares about the law. He does care about the evidence, and he rigidly applied the reasonable doubt standard.”
He said that his client is “the last person who would ever seek the spotlight,” saying that he is a devout Catholic, a quiet person, and a father who “loves his daughter more than anything in the world.” He said that while Desronvil’s Catholic faith “gives him a very strong moral foundation,” his faith was not what he based his decision on.
Paltzik said Desronvil is “very proud of his Haitian heritage,” and that he “came from a very close family, a family that gave him the values and virtues from a very young age.” He added that Desronvil is “proud to be a citizen of the United States of America” and loves the country.
He said that Desronvil is not in hiding, but measures are being taken to ensure his safety, adding, “Michael doesn’t run. Michael’s not afraid.” He also addressed reports of a domestic violence charge against Desronvil and a subsequent restraining order, claiming that “every single allegation against Michael is false, fabricated, never happened, categorically false.”
Paltzik said Desronvil believes strongly that the trial is about getting justice for the three children who were killed, not for “Lindsay Clancy’s needs or what’s good for Lindsay Clancy.” He said, “Michael wanted these three innocent children who never had a chance to have a voice, have a legacy, and to be remembered. And that's what this trial is about. It's about three innocent children who were murdered by their demonic mother. And this shouldn't be controversial.”
Paltzik said his message for Reddington and “deranged individuals who think that the murder of three innocent children is okay” was: “you will never break Michael, because Michael is indestructible.”
McEnany said she was able to speak with Desronvil briefly off the record before the interview, saying she was “immediately struck” by how “very logical, very methodical, very kind, very warm, very much in good spirits” he was, “despite what he’s been up against.”
She said that Desronvil, during their conversation, “kept bringing it back to the children. Everything was about the children. You had jurors who felt otherwise, that there should be a moment that we talked about postpartum health, but for him, the animating principle was the children.”
