Fulton County District Attorney Fani Willis is expected to seek indictments against at least 12 other people next week when she presents her case to a grand jury, alleging that former President Donald Trump and allies “coordinated attempts to unlawfully alter the outcome of the 2020 elections” in Georgia, according to a new report.
The investigation into alleged efforts by Trump to pressure Governor Brian Kemp and Secretary of State Brad Raffensperger to overturn the election results, as well as a plan to use an alternative slate of electors, has been ongoing since 2021. Willis has stated that she plans to announce charges by September 1 at the latest.
Sources told CNN that the Democratic DA is looking to charge the group with conspiracy and racketeering charges so that she can bring a case against multiple defendants. According to the outlet, she has previously praised and used Racketeer Influenced and Corrupt Organizations (RICO) Act statutes “...in unorthodox ways to bring charges against teachers as well as musicians in the Atlanta area.”
The federal RICO Act, which the state law is modeled after, was enacted in the 1970s to help take down the mafia. If prosecutors show that there is an organization of people committing crimes together on a recurring basis, then members can be prosecuted for the crimes of the group.
The list of charges that prosecutors are considering also includes criminal solicitation to commit election fraud and conspiracy to commit election fraud, as well as solicitation of a public or political officer to fail to perform their duties and solicitation to destroy, deface or remove ballots.
Trump and many of his advisors are under the impression that they will be charged in Georgia next week, the outlet reported.
Willis has already subpoenaed former Republican Lt. Gov. Geoff Duncan, former Georgia Democratic state Sen. Jen Jordan and independent journalist George Chidi as witnesses in the case.
The trio previously, along with more than 75 other witnesses, testified before a special purpose grand jury that investigated Trump.
The expected indictments come as Trump is facing three other indictments including two from Special Counsel Jack Smith, one of which relates to alleged attempts to overturn the results of the 2020 election.
