US District Judge Allison Burroughs claimed that the Department of Homeland Security unlawfully sent out termination of “parole” emails to hundreds of thousands of people who came to the US through the CBP One app. 900,000 immigrants came to the US via the CBP One app under Biden.
The CBP One app was used by the Biden administration to admit a high flow of immigrants to be "paroled" into the US, as well as for some to claim asylum.
Immigrants coming to the US would register for an appointment at the border to claim asylum or apply for parole and then afterwards be released into the US pending an immigration court date, but those dates were often years later. When the Trump administration came into office, emails went out en masse to those who were "paroled" into the US, informing them that they could no longer stay.
“The regulations do not give the agency unfettered discretion to terminate parole,” Burroughs claimed in the decision. “When Defendants terminated the impacted noncitizens’ parole without observing the process mandated by statute and by their own regulations, they took action that was ‘not in accordance with law.’”
The email had been sent out in April 2025 to paroled immigrants, per NBC News. The judge ruled, "The terminations of class members’ parole statuses announced by the April 2025 Termination Email are VACATED pursuant to 5 U.S.C. § 706. Defendants are ordered to return class members to the parole status that they held prior to the April 2025 Termination Email."
It remains unclear if those who were told that their parole status was removed will now be legally paroled in the US.
“Under federal law, DHS had full authority to revoke parole. Canceling these paroles is a promise kept to the American people to secure our borders and protect our national security,” DHS said in a statement, calling it "blatant judicial activism.”
