POSO: Jussie Smollett's lawyers pulled a 'Smollett' in claiming judge attacked them

In essence, these attorneys made a similar "hoax" claim to the one their client made, Posobiec said.

Human Events Daily's Jack Posobiec took aim at the attorneys in Jussie Smollett's "hate hoax" trial in Chicago, where they tried to get the judge to rule a mistrial after claiming the judge attacked them. Judge James Linn declined. In essence, these attorneys made a similar "hoax" claim to the one their client made, Posobiec said.

"His lawyers are now claiming—this is how bad his case is going—his lawyers are claiming that the judge in the case attacked them. The judge attacked them and they're asking for a mistrial," Posobiec said.

It was Tamara Walker, one of Smollett's defense attorneys, who called for a mistrial, claiming that the presiding judge "lunged" at her in court.

The alleged "lunge" occurred while the defense was cross-examining the prosecution's witness Olabinjo Osundairo, who claims he was paid to help Smollett stage the hate crime.

It was reported by the Chicago Tribune's Megan Crepeau that Judge Linn tried to "hustle things along, saying Walker is getting into something 'collateral.' She asks for a sidebar, the jury is sent out of the room, and she asks for a mistrial — in part because of the 'collateral' comment."

"Walker is also saying that Linn lunged at her during a sidebar: 'You did physically lunge at me.' Linn seems furious and is denying it outright," Crepeau reported.

Matt Finn of Fox News corroborated this account, saying "Right now, court is paused. Smollett's attorney asked to compose herself. She claims judge lunged at her. Judge says he stood up." Judge Linn did not go for the mistrial.

"I don't know exactly what the sentencing phase is going to be in this," Posobiec commented, "but Jussie, you got caught. And it's so bad that your own lawyers are trying to do everything they can to literally pull a Jussie Smollett to get out of this."

"The judge ain't gonna buy it. And I guarantee you, the jurors are definitely not going to buy it," he warned.

"You messed up, man. You messed up. You didn't like that you weren't getting paid enough on your show that you wanted to go big. You thought you could play games and everyone in politics went along with this it's very sad," Posobiec said.

Smollett has testified that there is "no hoax."
