President-elect Donald Trump responded to President Joe Biden's pardon of his son Hunter on Sunday night, saying the real "miscarriage of Justice" is the ongoing imprisonment and prosecution of the J6 protesters. "Does the Pardon given by Joe to Hunter include the J-6 Hostages," he asked, "who have now been imprisoned for years? Such an abuse and miscarriage of Justice!" Biden's statement on the pardon of his son said that "politics" had gotten in the way of justice and that had created a "miscarriage of justice."

Biden pardoned his son after years of saying that he would not do so. His only living son Hunter had pleaded guilty to tax evasion charges in September and was convicted on gun charges. Sentencing for both crimes were due to take place in December. Biden's pardon for his son extends to any crimes or potential prosecution over a 10 year period.

Trump has promised to pardon all non-violent offenders who were prosecuted by Biden's DOJ for crimes relating to the J6 protest. That protest, on January 6, 2020, saw Trump supporters enter the Capitol Building in an attempt to stop the certification of the electoral votes for Joe Biden, making him the 46th president. Many of those supporters were tried for trespassing.

In his pardon, Biden said "From the day I took office, I said I would not interfere with the Justice Department's decision-making, and I kept my word even as I have watched my son being selectively, and unfairly, prosecuted." In his conclusion, he said "Here’s the truth: I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice – and once I made this decision this weekend, there was no sense in delaying it further. I hope Americans will understand why a father and a President would come to this decision."

Many had criticized Trump's promise to pardon J6ers, which include grandmothers, first time offenders, and rioters. Others have pointed to the lack pf prosecution for the BLM and Antifa rioters who attempted to set federal buildings on fire throughout the summer of 2020 after George Floyd's death in Minneapolis, causing billions of dollars in damage.
