The Biden administration's Department of Homeland Security (DHS) has filed a Supreme Court supplemental memorandum against the state of Texas for protecting the southern border.
Filed on Friday, the document states that the DHS is filing the motion because of "new activities by the Texas National Guard and Department of Public Safety."

View on RumbleThe supplemental memorandum states that the DHS had learned on Jan. 10 that "National Guard members had begun erecting new concertina wire barriers." Since the new border wire is further "inland" and "restricts Border Patrol’s ability to reach the [Rio Grande] in particular areas" the DHS is pursuing a legal battle.
Armed personnel from the Texas National Guard, as well, have blocked border patrol agents from accessing specific areas which prevents border patrol "from using an access road through the preexisting state border barrier," according to the filing.
After the Biden administration cut razor wire at the border of Texas earlier in 2023, Texas Attorney General Ken Paxton sued the administration for its actions, which has led to a tit-for-tat legal battle from the Biden administration as well as the state of Texas. The Biden administration asked SCOTUS at the beginning of the year to reinstate control over the boundary between Mexico and Texas in order so border patrol could cut the razor wire in place.
As record-high illegal immigration at the southern border has taken place, it continues to be one of President Joe Biden's most controversial policy issues.
