A clip of Biden from a November 2022 press conference has resurfaced after the Colorado Supreme Court ruled that Trump is ineligible to be on the 2024 primary ballot, in which Biden said that he was making sure Trump would not be the next president.
"Well, we just have to demonstrate that he will not take power by — if we — if he does run. I’m making sure he, under legitimate efforts of our Constitution, does not become the next President again," Biden said. Trump launched his 2024 presidential campaign on November 15, 2022.

On Tuesday evening, the Colorado Supreme Court ruled that Trump was ineligible to be on the ballot in the state under Section Three of the Fourteenth Amendment to the United States Constitution.
Since "he is disqualified, it would be a wrongful act under the Election Code for the Colorado Secretary of State to list him as a candidate on the presidential primary ballot," the court stated.
It goes on to note that the court will stay its ruling until Jan. 4, 2024, "subject to any further appellate proceedings."
This is the first case that has determined that Trump should be removed from the ballot, with cases in Michigan and Minnesota being dismissed. California's lieutenant governor has urged the secretary of state to look into legal options to remove him from the ballot.
The Trump team is expected to file an appeal with the Supreme Court.
