Schubert engaged in a physical altercation with law enforcement, during which he "put his left shoulder and arm on an officer" and pushed the officer with his weight. Schubert also attempted to punch an officer but retreated after being sprayed with a chemical irritant.
Court documents also revealed that Schubert entered the Capitol by climbing into a broken window near the Senate Wing Door. After entering the building, he assisted his parents in climbing into the same window.
Since January 6, 2021, over 1,470 individuals from nearly every state have been charged for actions related to the events of that day, with more than 530 of these individuals charged with assaulting or impeding law enforcement officers. However, the Supreme Court ruled last month that the DOJ had incorrectly charged hundreds of defendants with obstructing an official proceeding. Approximately 350 individuals at the Capitol on January 6 were charged under the obstruction law.
