An illegal immigrant who was previously deported in 2009 and admitted to strangling her newborn son in 2013 was arrested by immigration authorities in New York last week.
Maria Oliva Guaman, 33, was arrested by Enforcement and Removal Operations (ERO) New York City after being released from the New York State Department of Corrections.
In 2009, after being removed and sent back to Ecuador, Guaman unlawfully re-entered the United States at an unknown location. In 2013, she was arrested for murder charges of her infant son after strangling him and throwing him in a dumpster.
She was convicted of manslaughter and sentenced to 12 years in prison and was to be sent back to Ecuador after completion of her sentence.
According to news reports at the time, Guaman admitted to the strangulation and putting her newborn son in the dumpster. The baby's remains were found the day after the disposal at the recycling plant.
At the time of trial, defense psychiatrists determined that she had suffered brain damage when she was kicked in the head by a horse at the age of 7 and she had extreme emotional disturbance at the time of the crime.
“The absolute heinous nature of the crime cannot be overstated as this woman strangled her newborn baby to death and tossed him in a dumpster,” said ERO New York City Field Office Director Kenneth Genalo about the case. "ERO NYC will seek to effect her removal to Ecuador.”
