WATCH: Ted Cruz slams Democrats for lack of transparency over Jan 6

In a Senate Judiciary Committee hearing earlier in the day, the Department of Justice took questions from Senators about their programs to combat domestic terrorism.

Senator Cruz challenged Jill Sanborn, executive assistant director of the National Security Branch of the FBI, asking what role the FBI played in Jan. 6. He asked her outright "How many FBI agents or confidential informations actively participated in the events of January 6?" Sanborn declined to answer, saying she could not go into "sources and methods."

Talking to Fox News' Sean Hannity, Senator Cruz said that the Department of Justice and the FBI have been inundated by partisan politics.

"Unfortunately, under Joe Biden we have seen an incredibly partisan Department of Justice. Both the Department of Justice and the FBI have an arrogance that they are not accountable to anyone. They can stonewall," Cruz told Hannity. "So it should be very easy for the FBI to say, 'No.'"

To say, "'No federal agents participated in violent crimes. No federal agents actively incited and encouraged others to commit violent crime.' If they were doing their jobs those would be very easy questions to answer," Cruz alleged. "They refuse to answer those."

The Texas senator went on to explain how both the FBI and the Department of Justice were deeply politicized during Trump's presidency. They were weaponized by Democratic officials to try to "take Trump out," Cruz said.

For example, Robert Mueller, the former Special Counsel for the Department of Justice and Director of the FBI, enacted a years long "witch hunt" against former President Trump over the Russia collusion scandal which turned out to be a Hoax, Cruz explained.

On the topic of Ray Epps, Senator Cruz questioned whether or not he was an undercover FBI agent or informant. Epps was featured in multiple videos inciting violence during the January 6 rally at the US Capitol.

The FBI originally had Epps listed as a suspect and asked the public to help identify, but he was quickly removed and was never charged, raising obvious red flags. The Jan. 6 committee since released a statement that they had spoken to Epps and found nothing of interest to report.

"The Select Committee is aware of unsupported claims that Ray Epps was an F.B.I. informant based on the fact that he was on the F.B.I. wanted list and then was removed from that list without being charged," the statement read. "The Select Committee has interviewed Mr. Epps. Mr. Epps informed us that he was not employed by, working with or acting at the direction of any law enforcement agency on Jan. 5 or 6 or at any other time, and that he has never been an informant for the F.B.I. or any other law enforcement agency."

"There needs to be transparency and the Biden administration needs to fess up, 'Is this a politicized law enforcement operation that is targeting the enemies of the president and did they actively encourage and solicit illegal conduct?'" Cruz said.
