Mian has been charged with second-degree murder and has been remanded into custody before his upcoming court appearance on Thursday.
As CTV News reported, the shooting occurred Sunday morning around 5 am at Mian's residence in Milton, where he lives with his mother. As Halton Regional Police Service told the outlet, a group of suspects "intent on committing a robbery" approached the home, but they were confronted upon entry.
"A number of gunshots" were reportedly fired, leading one man to be pronounced dead at the scene while two others were arrested when police arrived. While the identity of the deceased suspect has not yet been released, the police did say in a press release that the other arrested individual was Romario Clarke, 20, of Oshawa, who was charged with breaking and entering and the unauthorized possession of a firearm.
Meanwhile, Mian has been charged with second-degree murder and has been remanded into custody before his upcoming court appearance on Thursday after making his first brief one on Tuesday.
In a statement to CP24, Mian's lawyer, Jag Virk, said his client "shot at an intruder that broke into his home and attacked his mother."
"He is a registered firearm owner and used his gun legally against an armed intruder. He shouldn't be charged with murder for protecting his mother from someone that broke into his home," Virk said.
He added that Mian’s intention was "not to kill the intruder, he only shot at him once."
At first, police said the shooting was "isolated to the home and appears to be targeted," though the official statement updated on Monday omitted that detail.
During his Mian's court appearance, Virk told CP24 reporters that he intends to request bail for his client, and that "He definitely [had] a right to defend himself and that's going to be his defense."
"It was a home invasion. Intruders were in his house. Armed, dangerous. And he protected himself and his mother, that is it," Virk said.
Police are still searching for the other three suspects seen at the home that morning, who they said made their getaway in a light-colored Dodge Charger with a sunroof and black wheels.
