On Wednesday, an Air Force veteran pleaded guilty to a misdemeanor charge after entering the Capitol building on Jan. 6 and was sentenced to jail for 45 days.
The sentencing marks the first misdemeanor plea that lead to jail time for someone charged in connection to the Jan. 6 riot who was not held prior to sentencing, according to ABC News.
Derek Jancart had previously pleaded guilty for disorderly conduct in connection to his actions that day. He was not accused of participating in violent actions during the riot.
Following his plea, the Justice Department had requested that Jancart be sentenced to four months in jail, which ABC News notes is "more than they have requested for other lower-level misdemeanor defendants."
Prosecutors noted Jancart's previous military experience in their request, saying he "swore an oath to defend the country, and instead participated on an attack against democracy itself." Jancart and his attorney asked Judge James Boasberg to instead sentence him to probation.
Jancart apologized for his actions when appearing in court on Wednesday, saying he "didn't go there to hurt anybody."
"I did get caught up in the moment ... I wish in hindsight I had stayed back," Jancart told the court." I love this country and I feel ashamed of my actions."
