Bystander video from January 13 shows a man identified by multiple online sources as Pretti approaching Immigration and Customs Enforcement agents who were blocking a street. In the footage, he is seen shouting at agents and kicking their vehicle.
At one point in the video, a federal agent exits the vehicle, grabs the man and pushes him to the ground. Other agents then fire tear gas and pepper balls into the nearby crowd to disperse agitators and prevent interference.
The footage also shows what appears to be Pretti getting free from the initial hold. At that point, a firearm is visible in his waistband. The Department of Homeland Security has confirmed to Fox News that it is aware of the new video footage, and said that Homeland Security Investigations is looking into it.
Pretti was among roughly 50 anti-ICE agitators who confronted Border Patrol agents on the day he was shot and killed. The shooting has sparked debate, as Border Patrol head Greg Bovino initially claimed that Pretti was looking to inflict "maximum damage and massacre law enforcement" before he was shot by Border Patrol agents. That claim has been disputed since the release of bystander footage that showed Pretti did not initially have his firearm in his hand, leading many to call for an investigation into whether or not the shooting was justified.
On Wednesday, it was reported that the two agents who fired their weapons in the shooting of Pretti have been placed on administrative leave.
