BREAKING: Biden DOJ urges judge to throw Hunter’s ex-business partner Devon Archer in prison just one day before he is set to testify to Congress

Devon Archer, who is set to testify before Congress on Monday as to what he knows about the business relationship between Joe Biden and his son Hunter, is the subject of a letter from the Department of Justice to the Southern District of New York on Saturday.

Archer's attorney said that Archer intends to report to Congress on Monday as planned. “We are aware of speculation that the Department of Justice’s weekend request to have Mr. Archer report to prison is an attempt by the Biden administration to intimidate him in advance of his meeting with the House Oversight Committee,” Archer's attorney said in a statement, per Politico.

“To be clear, Mr. Archer does not agree with that speculation. In any case, Mr. Archer will do what he has planned to do all along, which is to show up on Monday and to honestly answer the questions that are put to him by the Congressional investigators.”



The letter was sent to trial Judge Ronnie Abrams, asking for a date to be determined as to when Archer must report to prison to serve time for unrelated charges. The court declined to comment. 

The letter asks for a date to be set for Archer to report to prison after a 2018 conviction on charges to defraud a Native American tribe. Archer is still appealing the conviction, as he has been doing since the ruling. Archer's 1-year sentence was upheld by the Second Circuit Court of Appeals.

Signed by US Attorney Damian Williams, the letter states that "...the Government respectfully requests that the defendant be ordered to surrender, at a date and time determiend by the Court, to a facility designated by the Buraue of Prisons to commence his term of imprisonment. The Government has conferred with counsel for the defendant about this request and asked that counsel propose a date for the defendant's surrender. Counsel responded with the following posiiton: 'Mr. Archer believes it is premature to set a report date in light of his anticipated continuing appeal as well as the newly-discovered sentencing error that the government has now conceded. Counsel for Mr. Archer will put in a response to the Government's request by Wednesday.' The Governemnt disagrees with counsel's position that a report date shoudl not be set, and respectfully requests permission to respond to any arguments made by the defendant."

Miranda Devine said that Archer has information about meetings Hunter Biden organized that Archer attended. She said that Archer can testify that Joe Biden was on phone calls in those meetings. Archer, Devine said, witnessed the meetings and "there are up to a dozen of these speakerphone calls" in Hunter Biden's international business dealings, in which Joe Biden was brought into the meetings via speakerphone.

A call of this nature in 2015, Devine attested, took place right after a Burisma board meeting. This was right before then VP Joe Biden threatened to withhold promised aid to Ukraine unless their fired prosecutor Viktor Shokin, who was looking into Burisma's shady dealings. He is alleged to have participated in 24 of these calls.



Archer was subpoenad by Rep. James Comer in June to testify before the House Oversight Committee. That interview will be transcribed, but behind closed doors.

“The Committee is investigating foreign nationals’ attempts to target and coerce high-ranking U.S. officials’ family members by providing money or other benefits in exchange for certain actions," Comer said. "The Committee is considering legislative solutions to this problem. The Committee has identified Mr. Archer as possessing information relevant to its investigation and seeks your client’s testimony regarding these and other related topics."

“Both information that the Committee has reviewed and public reporting indicates that Mr. Archer played a significant role in the Biden family’s business deals abroad," Comer continued, "including but not limited to China, Russia, and Ukraine. Additionally, while undertaking these ventures with the Biden family, [Mr. Archer] met with then-Vice President Biden on multiple occasions, including in the White House."

"Mr. Archer’s testimony is critical to the Committee’s investigation. Mr. Archer was Hunter Biden’s business partner in a number of transactions involving foreign nationals and foreign companies. Mr. Archer is associated with corporate entities that the Committee has identified and the Biden family’s role in each of them. Furthermore, he has significant information regarding the purpose of these companies and knowledge of relevant documents related to the Committee’s investigation."
