Biden is weighing plans to call for a constitutional amendment to strike down immunity for presidents.
Joe Biden is reportedly finalizing plans to back changes to the US Supreme Court, which will reportedly include proposals for the establishment of term limits in addition to an enforceable ethics code, two people briefed on the plans told the Washington Post.
Biden is also reportedly weighing plans to call for a constitutional amendment to strike down the immunity in place for presidents and other office holders, the sources added. Biden’s plans come after the Supreme Court delivered its final opinion day of the 2024 term in Trump’s presidential immunity challenge, ruling that he has immunity for official acts.
Biden reportedly spoke about the plans in a Zoom call with the Congressional Progressive Caucus on Saturday. "I’m going to need your help on the Supreme Court, because I’m about to come out — I don’t want to prematurely announce it — but I’m about to come out with a major initiative on limiting the court … I’ve been working with constitutional scholars for the last three months, and I need some help," Biden said in a transcript of the call obtained by the outlet. Congress is the body that can make changes to the composition of the Court, not the president.
The US Constitution, Article III states that Justices "shall hold their Offices during good Behaviour," meaning that justices "hold office as long as they choose and can only be removed from office by impeachment," the Supreme Court states.
Following the Supreme Court's Trump decision, Biden said in an address, "No one is above the law, not even the President of the United States. With today's Supreme Court decision on presidential immunity, that fundamentally changed." He added that the decision "undermines the rule of law" in the US. Biden claimed that the court’s decision was part of a “course of attack in recent years on a wide range of long-established legal principles.”
Biden's move to black changes to the high court also comes as calls for Biden to drop out of the presidential race continue. The widespread calls came after Biden's dismal debate performance in June, with Democrat politicians and pundits supporting the push.
