While his alleged crime was in 2016, he wasn't arrested until 7 days after Joe Biden was innaugurated in 2021. The FBI came to his home at 7:30 in the morning, dragged him out of his home in handcuffs, and didn't even tell him what he was being arrested for until he was arranged at the courthouse. He told all this to Tucker Carlson.
To Hillary Clinton, who celebrated Mackey's arrest, Mackey's joke went "from what you would consider free speech... to running a very deliberate effort to mislead people about where and how to vote. So it went from speech to action meant to subvert the election, because thousands of people who they targeted through their algorithms, 'oh I could text my vote for Hillary Clinton."
Mackey posted the meme because he thought it was funny. During his trial, the Department of Justice could not present one person who was a "victim" of this meme. Hillary Clinton voters posted very similar memes, advising Trump voters to vote by text. None of them were arrested.
Yet Mackey was found guilty on charges of election interference. A fundraiser has been launched for his legal fees.
The meme in question
Carlson walked through the crime with Mackey, calling it a violation of the First Amendment. Mackey said there was an outpouring of support from the American people, though not the ACLU, who cheered on his arrest.
"I don't think they care too much about the First Amendment anymore," Mackey said.
"You were convicted on the basis of what they said your intent was," Carlson said.
Mackey agreed. Yet he was charged with conspiracy against rights, election interference, and these allegtions were bolstered and cheered by lefitst media intent on punishing a Trump supporter. It was Huffington Post reporter Luke O'Brien's doxxing of Mackey that led to his arrest and conviction.
Mackey said he hopes the sentence will be an opportunity because "there's something redemptive about suffering."
