According to an MSNBC report on Wednesday that cited three sources, Comey is facing imminent indictment in the Eastern District of Virginia.
MSNBC correspondent Ken Dilanian posted on X: “The full extent of the charges being prepared against Comey is unclear, but the sources believe that at least one element of the indictment—if it goes forward--will accuse him of lying to Congress during his testimony on September 30, 2020 about whether he authorized a leak of information. The five year statute of limitations on that charge would lapse on Tuesday.”
Should a federal grand jury approve the case, it would be one of the highest-profile indictments during Trump’s second presidency. In a social media post on Friday aimed at Attorney General Pam Bondi, President Trump called Comey "guilty as hell" and criticized the lack of action against Comey, as well as others.
The possible indictment comes after internal disputes within the Justice Department over whether to move forward. Erik Siebert, the acting US Attorney for the Eastern District of Virginia, resigned last week after resisting pressure from the Trump administration to file charges.
MSNBC reported that Siebert opposed indicting Comey, but President Donald Trump publicly claimed Siebert was dismissed.
“No, I fired him, and there is a GREAT CASE,” Trump wrote on Truth Social. He accused Siebert of misleading the media by suggesting he resigned voluntarily. “That’s why two of the worst Dem Senators PUSHED him so hard. He even lied to the media and said he quit, and that we had no case.”
The case under consideration involves Comey’s testimony to Congress in September 2020. At that time, Senator Ted Cruz asked whether Comey had approved or authorized leaks of FBI information to the Wall Street Journal for an October 2016 article about a Justice Department review of Hillary Clinton’s email practices. Comey denied doing so.
Cruz later told the Justice Department that Comey’s statements conflicted with those of former FBI Deputy Director Andrew McCabe. “Mr. McCabe says that he told Mr. Comey of the leak and that Mr. Comey approved—effectively authorizing the leak after the fact,” Cruz wrote. “Mr. Comey, on the other hand, has said that he neither authorized the leak nor knew of Mr. McCabe’s involvement. One of them is lying under oath—a federal crime.”
Comey had previously testified in 2017 that he had never been an anonymous source in coverage of either Trump or Clinton investigations, nor had he directed subordinates to act as sources. In 2020 testimony, he reaffirmed that position.
Trump has continued to press the issue, writing that Comey, as well as New York Attorney General Letitia James, and Rep. Adam Schiff are “all guilty as hell.”
President Trump has gone on the record saying that he would not have a problem seeing Comey and former CIA Director John Brennan arrested over the Russiagate hoax. Trump made the statement after Director of National Intelligence Tulsi Gabbard revealed a number of details in the case in July.
"So James Comey and John Brennan, would you be comfortable seeing them handcuffed and arrested live on TV?" the Daily Caller's Reagan Reese asked Trump when the two were discussing Russiagate.
"Would not bother me at all," Trump replied.
"Do you think it’s a possibility?" Reese asked.
"See, I wouldn’t have answered that question that way four years ago. Do you understand that? I wouldn’t. Because, well, Hillary’s a good example. We had Hillary cold. I didn’t want to see that. I didn’t want the, you know, the wife of a president, to go to jail, but she was stone cold guilty of things. And if you remember, at the, at the big rallies, I’d say, ‘Alright, take it easy.’ You know, they’d all say, ‘Lock her up. Lock her up.’ After we won, before I won, just, they could do whatever they wanted. After I won – yeah, I was very gracious. And I assumed that, you know, I was a president, we had a great first term, first, not like this one, though," the president said.
Gabbard released several documents earlier this year and accused officials in the Obama administration of engaging in a "treasonous conspiracy" to undermine Trump before he came into office, making it seem as though he was connected to Russia. The FBI has reportedly launched probes into both Comey as well as Brennan related to the Russia collusion hoax.
