"If this law means anything, the trial court’s actual findings here establish an actual conflict," Trump's application for appeal stated.
The Georgia Court of Appeals has agreed to hear an appeal filed by former President Donald Trump to review a lower court's ruling that allowed Fulton County District Attorney Fani Willis to continue prosecuting him in his election case in the state.
The decision to grant the appeal follows revelations of an intimate relationship between Willis and one of the prosecutors involved in Trump's case, Nathan Wade. The appeal was accepted on Wednesday, allowing it to be heard before the case proceeds to trial.
"Upon consideration of the Application for Interlocutory Appeal, it is ordered that it be hereby GRANTED,” the Georgia Court of Appeals stated in its ruling.
Previously, the judge presiding over the case had ruled that the case could continue if Wade, the lead prosecutor, or Willis resigned from the case. Wade was the one who resigned. However, Trump's legal team argued that there was a conflict of interest and Willis should have been disqualified from prosecuting the case.
"If this law means anything, the trial court’s actual findings here establish an actual conflict," Trump's application for appeal stated.
The granting of the appeal is expected to delay the trial date and court proceedings, according to The Hill.
“President Trump looks forward to presenting interlocutory arguments to the Georgia Court of Appeals as to why the case should be dismissed and Fulton County DA Willis should be disqualified for her misconduct in this unjustified, unwarranted political persecution,” said Steve Sadow, one of Trump’s Georgia attorneys.
