The ruling stated that remote attendance at the hearing was authorized with provisions
Tyler Robinson, the man charged with killing Charlie Kirk, will be back in court on Friday, however, a new order from Judge Tony Graf has revealed that no video streaming of the hearing has been requested by media outlets, nor “is authorized by this order.”
An order granting still photography access for Deseret News read, “The October 2, 2026 order granting Deseret News' Request (Dkt. 756) is CONFIRMED for the October 23, 2026 trial-setting hearing, subject to the existing requirements identified below. No media video or audio coverage was requested or is authorized by this order. Court-provided remote access under paragraph 7 is separately authorized.”
Paragraph seven stated that remote attendance at the hearing was authorized with provisions. It states that “This remote-access authorization does not permit media broadcasting or recording. All other participants' manner of appearance remains unchanged.”
The provisions issued by Graf stated that Burt’s request to attend remotely was granted, and that Erika Kirk, her attorney, or both may attend remotely. The ruling stated that connection information using a “Judicial Council-approved platform” would be provided to Burt and Kirk before the hearing, and that “Before deciding a matter requiring Mr. Burt's participation or implicating an applicable victim's right to be heard, the court shall address any reported connection failure on the record and determine an appropriate means of proceeding.”
Friday’s hearing is the first to take place after Graf ruled in September that Robinson must stand trial for the 2025 killing of Charlie Kirk. Graf ruled on September 1 that probable cause had been established, and Robinson pleaded not guilty to all counts.
