The lawsuit against Elon Musk for giving away $1 million to random registered voters who sign his petition in swing states has been placed on hold as the lawyers for Musk have argued that the case should go to the federal courts.
According to the Associated Press, lawyers for Musk filed a motion on Wednesday to move the lawsuit case to the federal courts, arguing that it involves a federal issue. Judge Angelo Foglietta said that the lawsuit would be placed on hold in the meantime.
Earlier in October, Musk announced the initiative that would be giving away $1 million a day to random voters who signed his petition from his America PAC that are registered to vote in swing states. The petition is in support of free speech and gun rights.
Philly District Attorney Larry Krasner brought the suit and argued that the $1 million giveaways were illegal, claiming that Musk violated lottery laws in the state. The DA sidestepped questions surrounding whether or not Musk's giveaways were incentivizing voting, NBC News reported. The giveaways' legality originally came into question as some analysts argued that it would be similar to buying votes or voter registrations.
Krasner claimed in the lawsuit that Musk and the PAC "are indisputably violating Pennsylvania’s statutory prohibitions against illegal lotteries and deceiving consumers."
"America PAC and Musk are lulling Philadelphia citizens—and others in the Commonwealth (and other swing states in the upcoming election)—to give up their personal identifying information and make a political pledge in exchange for the chance to win $1 million. That is a lottery," the lawsuit states.
Musk has committed more than $70 million to the America PAC, and endorsed Trump in July right after the Butler shooting took place in the swing state. Musk has also toured around the state, hosting town halls and campaigning for Trump.
Both Trump as well as Kamala Harris have been making large efforts in Pennsylvania to turn out the vote as well as appeal to voters in order to take the state’s 19 electoral votes come Election Day.
