Philadelphia District Attorney Larry Krasner is suing tech entrepreneur Elon Musk over his America PAC offering $1 million at random to registered voters who sign his petition supporting the First and Second Amendments to the Constitution.

"America PAC and Musk are lulling Philadelphia citizens—and others in the Commonwealth (and other swing states in the upcoming election)—to give up their personal identifying information and make a political pledge in exchange for the chance to win $1 million. That is a lottery," the lawsuit states, per NBC News. Krasner claimed in the lawsuit that the petition is "indisputably an unlawful lottery" in the state of Pennsylvania.

Earlier this month, Musk announced with his petition his PAC would pay people $47 per referral if they got registered swing state voters to sign the petition. He later said that he wanted the petition to gain more public attention and was willing to put up more cash for those who signed the petition in the swing states. Musk announced on October 19 that the PAC would give $1 million to a random petition signer each day until the election.

The move came under legal scrutiny, with some questioning if it was illegal for him to incentivize voter registration with the random $1 million awards. However, Musk said on Friday that it "is not a petition to vote for or register for anyone. It’s really a petition in support of the Constitution of the United States, and in particular, freedom of speech and the right to bear arms."

The move from the Philly DA to sue Musk comes after the Biden-Harris administration claimed that the SpaceX CEO was an illegal worker while he was here on a student visa. "That wealthiest man in the world turned out to be an illegal worker here. No, I’m serious. He was supposed to be in school when he came on a student visa. He wasn’t in school. He was violating the law. And he’s talking about all these illegals coming our way?” Biden said in a town hall in Pittsburgh on Saturday.

Musk has been very vocal in his support of Trump as well as for policies to secure the southern border.
