“After a careful and thorough review of all these factors, the district attorney’s office will not be seeking the death penalty in this case."
"In deciding whether or not the DA's office was going to seek the death penalty, we have gone through a rigorous review where we look at the aggravating factors, as well as the mitigating factors – where we have spoken to the victims' family, we have spoken to prosecutors, law enforcement, and I've worked with the most senior people in the district attorney's office," Hochman said.
“After a careful and thorough review of all these factors, the district attorney’s office will not be seeking the death penalty in this case,” Hochman told reporters on Tuesday. “That means that the maximum sentence that Mr. Reiner will be looking at is life without the possibility of parole.”
The DA did not disclose what the family is seeking in terms of punishments for Reiner, but both his parents were against the death penalty. “We did speak with Nick Reiner’s siblings (and) they made their views very clear,” Hochman added. “We took their views into consideration in ultimately deciding not to seek the death penalty.”
Reiner has been charged with two counts of murder in the killing of his parents. Rob and Michele Reiner were found dead with stab wounds in their home in Brentwood, California. Hours after their bodies were found, authorities arrested their son, Nick.
Nick Reiner's siblings have asked that the grand jury transcripts stay sealed. “They basically have said that the disclosure to the public and the media of the details and evidence of the killing of their parents will cause them additional trauma and harm, and they have respectively asked for the court to keep the transcript sealed,” Hochman said.
Reiner has pleaded not guilty in the killings.
